Legal IT Insider has released the third instalment of its Gen AI and the Practice of Law series, shifting focus from adoption to accountability. Titled The Governance Gap: How Law Firms Can Take Control of AI Before AI Takes Control of Them, the June 2026 report argues that the profession's defining AI question has moved on from what the technology can do to how firms prove it is being used safely and defensibly.
Led by analyst Neil Cameron, the report frames governance not as a brake on legal work but as the infrastructure that makes AI-enabled work possible at all. It breaks the challenge into four connected layers — strategy, process, forensic defensibility, and client governance — covering topics from AI orchestration layers and agentic workflows to recent court rulings exposing the gaps in how firms validate AI output, and the growing role of clients as de facto regulators through AI procurement questionnaires.
As Cameron puts it, "Governance is the key, not the lock" — and the report lays out where firms need to turn that key first.
